Terms of Service

HumanosX is a consumer wellness, fitness, nutrition, body-scan, product scoring, and real-world food decision app. It is designed to help users plan workouts, understand nutrition, evaluate products and places, and make better daily wellness decisions.

You are responsible for using HumanosX lawfully, keeping your account secure, and reviewing recommendations before acting on them.

You must be at least 18 years old to create an account and use the Service, or at least 13 years old with the involvement and consent of a parent or legal guardian who agrees to these Terms on your behalf. The Service is not directed to children under 13. By using the Service you represent that you meet these requirements and that any information you provide is accurate.

HumanosX does not provide medical advice, diagnosis, treatment, prevention, cure, or emergency support. Body scans, nutrition estimates, mission recommendations, AI Coach outputs, workout plans, product scores, and place recommendations are informational wellness tools.

Consult a qualified healthcare professional before making health, diet, supplement, or exercise decisions, especially if you have a medical condition, injury, allergy, eating disorder history, are pregnant, or are under professional care.

You may provide profile data, preferences, food logs, workout logs, body scan photos, barcode scans, location permissions, support messages, and other content. You are responsible for making sure the information you provide is accurate and that you have the right to upload any content you provide.

You grant HumanosX permission to process your content to operate, personalize, secure, and improve the service, subject to the Privacy Policy.

Body scan features are optional and are intended to provide broad wellness and fitness direction, visible strengths, priority areas, and mission support. Body scans do not provide medical diagnosis, pain or injury assessment, or exact body-fat measurement. You must be at least 18 years old to use a body scan, even where a parent or guardian may otherwise be involved in your use of the Service.

• Wear fitted clothing and use a well-lit, private environment.
• Do not upload nude, explicit, unsafe images, or images of another person.
• Review scan previews before submitting them for analysis.
• Comparisons are directional and may be marked uncertain when capture conditions or analysis versions are not comparable.
• Confirm any optional workout accommodation before relying on it, especially if you have pain, injury, or limited mobility.
• Delete an individual scan or your account if you no longer want the derived report associated with you.

HumanosX may use AI to help generate summaries, explanations, meal ideas, workout context, product or menu parsing, and coaching insights. AI output can be wrong, incomplete, or unsuitable. Deterministic scoring and source evidence may also be limited by available data.

Unknown oil, sourcing, ingredients, allergens, restaurant methods, inventory, or supplement testing should be treated as unverified. HumanosX scores and explanations are not guarantees of safety, quality, availability, or suitability.

Product, restaurant, grocery, menu, and nutrition data may come from third-party sources, user submissions, barcode databases, place data, labels, or AI-assisted interpretation. Information can be outdated, incomplete, mistranslated, or inaccurate.

Always check labels, allergens, ingredients, preparation methods, restaurant staff answers, and your own dietary needs before eating, buying, or using a product.

HX Map and nearby recommendations rely on location and third-party place data when you enable those features. Places discovered through maps or external data are not necessarily inspected, approved, verified, open, available, or suitable for your mission.

Google Maps Platform powers map and place discovery portions of HX Map. Your use of those features is also subject to the Google Maps/Google Earth Additional Terms of Service and the Google Terms of Service. Google processes information as described in the Google Privacy Policy.

Physical exercise carries inherent risks, including muscle strain, joint injury, cardiovascular events, and, in rare cases, serious injury or death. Workout recommendations are general in nature and are not tailored medical or clinical guidance. You are responsible for using proper form, choosing appropriate weights and intensity, using safe equipment and surroundings, stopping if you feel pain, dizziness, shortness of breath, or otherwise unsafe, and seeking professional guidance where needed.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU VOLUNTARILY AND KNOWINGLY ASSUME ALL RISKS ASSOCIATED WITH YOUR USE OF WORKOUTS, NUTRITION GUIDANCE, AND OTHER ACTIVITIES SUGGESTED BY THE SERVICE, WHETHER OR NOT SUCH RISKS ARE DESCRIBED HERE. Obtain clearance from a physician before beginning any exercise or nutrition program, especially if you have a medical condition, are pregnant, or take medication.

Paid subscriptions automatically renew at the then-current price for the same term until you cancel. Subscriptions purchased through the App Store are billed by Apple and can be managed or cancelled in your App Store account settings; cancel at least 24 hours before the end of the current period to avoid renewal. Except where required by law, payments are non-refundable, and refund requests for App Store purchases are handled by Apple under its policies. We may change subscription prices or features prospectively with reasonable advance notice; changes apply at your next renewal.

Product and restaurant recommendations may be incomplete or unavailable and are not guaranteed to be allergen-free, mission-perfect, or suitable for your needs.

The Service may link to or rely on third-party services, merchants, restaurants, data sources, and Apple services. We do not control and are not responsible for third-party content, products, services, terms, or privacy practices. Your dealings with third parties are solely between you and them.

• Do not misuse the service or attempt to access another user's account or data.
• Do not upload illegal, explicit, harmful, or unauthorized content.
• Do not interfere with the app, backend, subscription verification, security systems, or infrastructure.
• Do not reverse engineer protected systems or bypass premium, safety, or access controls.
• Do not use HumanosX to make emergency, medical, or high-risk decisions.

Some features may be experimental, incomplete, unavailable, region-limited, or in beta. We may change, suspend, or discontinue features as the product develops.

HumanosX, the app experience, scoring systems, designs, text, graphics, software, and related materials are owned by HumanosX or its licensors. You may not copy, reuse, or commercialize them except as allowed by these Terms or with written permission.

You may stop using the Service or delete your account at any time. We may suspend or terminate your access to all or part of the Service at any time, with or without notice, if we reasonably believe you have violated these Terms, created risk or legal exposure for us or other users, or where required by law. Sections that by their nature should survive termination (including disclaimers, limitations of liability, indemnification, and dispute resolution) survive.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE AND ALL CONTENT, RECOMMENDATIONS, SCORES, AND FEATURES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, THAT DEFECTS WILL BE CORRECTED, OR THAT ANY RECOMMENDATION, SCORE, OR AI OUTPUT IS ACCURATE, COMPLETE, OR SUITABLE FOR YOU. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HUMANOSX AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THIS INCLUDES, WITHOUT LIMITATION, DAMAGES ARISING FROM PERSONAL INJURY, HEALTH OUTCOMES, ALLERGIC REACTIONS, RELIANCE ON RECOMMENDATIONS, SCORES, OR AI OUTPUT, THIRD-PARTY PRODUCTS OR PLACES, OR UNAUTHORIZED ACCESS TO YOUR DATA.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US $100). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU. NOTHING IN THESE TERMS EXCLUDES LIABILITY THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW.

To the maximum extent permitted by law, you agree to indemnify, defend, and hold harmless HumanosX and its officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms, your misuse of the Service, your content, or your violation of any law or the rights of a third party.

PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY TRIAL.

Informal resolution first: before filing a claim, you agree to contact us at contact@humanosx.app with a written description of the dispute and give us 30 days to try to resolve it informally.

Binding arbitration: except for disputes that qualify for small claims court or claims for injunctive relief relating to intellectual property or unauthorized access, any dispute arising out of or relating to these Terms or the Service will be resolved by final and binding arbitration on an individual basis, administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will be conducted in English, by videoconference or, if required, in the county where you live. Judgment on the award may be entered in any court with jurisdiction.

CLASS ACTION WAIVER: YOU AND HUMANOSX EACH WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE PROCEEDING. Claims may be brought only in an individual capacity, and the arbitrator may not consolidate more than one person's claims.

Opt-out: you may opt out of this arbitration agreement by emailing contact@humanosx.app with the subject "Arbitration Opt-Out" within 30 days of first accepting these Terms. Opting out does not affect any other part of these Terms. If the class action waiver is found unenforceable as to a particular claim, that claim (and only that claim) must proceed in court.

These Terms and any dispute arising out of them are governed by the laws of the State of Florida and applicable United States federal law, without regard to conflict-of-law principles, except where the law of your state of residence mandatorily applies. For any claims not subject to arbitration, you and HumanosX consent to the exclusive jurisdiction of the state and federal courts located in Miami-Dade County, Florida.

If you download the app from the Apple App Store: these Terms are between you and HumanosX, not Apple; Apple has no obligation to provide maintenance or support for the app; Apple is not responsible for addressing any claims relating to the app, including product liability, legal compliance, or intellectual property claims; and Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Your use of the app must also comply with the App Store Terms of Service.

These Terms, together with the Privacy Policy, are the entire agreement between you and HumanosX regarding the Service. If any provision is found unenforceable, the remaining provisions remain in full effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. We are not liable for delays or failures caused by events beyond our reasonable control.

We may update these Terms as HumanosX evolves. The updated version will be posted on this page with a new date. Continued use after changes means you accept the updated Terms.
